Orangeburg, SC: Norfolk Southern & State DOT pay-up to settle lawsuit

The Times and Democrat of Orangeburg has reported that court records show a settlement was reached last month with the estate of a woman killed when she was a passenger in a car that became stuck on a level crossing in 2011 with fatal consequences.

The lawsuit contended that Norfolk Southern (NS) and South Carolina’s Department of Transportation (DOT) knew that the level crossing was dangerous. Thus, by extension, the contention was the crossing could have been maintained in a way that prevented a car becoming stuck.

The deceased’s estate will receive USD155,000 with NS paying USD95,000 and the DOT USD60,000.
