Indiana: Increased blocked-crossing penalties proposed

With blocked crossing fines to USD500 already on the statute and actively used in Elkhart County in respect of Norfolk Southern Railway operations, Republican State Senator Carlin Yoder has proposed increasing the maximum fines that can be levied

Set out in Senate Bill 27, are the following proposed penalties

  • 10-20 Minutes: USD500 Class C Infraction  +  USD500 civil penalty
  • 20-25 Minutes: an additional USD200 civil penalty
  • 25-30 Minutes: a further additional USD200 civil penalty
  • 30+ Minutes: a further additional USD100 civil penalty, plus an additional USD500 civil penalty for each five minute increment.

Novel in this proposed legislation is the imposition of a civil penalty over and above that applying for a Class C infraction.
