Ontario, California: Litigation threatens to derail grade-separation project

A grade separation project which calls for a road-over-rail bridge to eliminate traffic delays at a level crossing on Milliken Avenue, Ontario could land the city in court. This is because the City Council has endorsed a resolution to use “eminent domain” if necessary on two properties. Lawyers representing property owners and tenants have said that the litigation route will be taken if easements are taken for the project go ahead. The lawyers asked that the Council delay their vote in order to give more time for an alternative design to be prepared. The City of Ontario has offered affected property owners compensation, but has been unable to reach agreement.
